1. Introduction

Welcome to fot.is (the "Platform"), operated by Vestra AI ehf., a company registered in Iceland (the "Company", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the Platform.

By accessing or using fot.is, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

2. Platform Description

fot.is is an online marketplace that connects buyers and sellers of clothing items, both new and used. The Platform allows individual users and businesses to list, browse, and purchase clothing items.

We act as an intermediary platform and are not a party to any transactions between buyers and sellers. We do not own, sell, resell, or control any items listed on the Platform.

3. User Accounts

3.1 Account Registration

To access certain features of the Platform, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized use of your account
  • Be at least 18 years old or the age of majority in your jurisdiction

3.2 Account Responsibility

You are responsible for all activities that occur under your account. You agree not to:

  • Share your account with others
  • Create multiple accounts to evade restrictions
  • Use automated systems or software to access the Platform
  • Impersonate any person or entity

4. Listing and Selling

4.1 Seller Obligations

If you list items for sale on the Platform, you agree to:

  • Provide accurate and complete descriptions of your items
  • Use only photographs that accurately represent the items
  • Specify the correct condition of items
  • Set fair and reasonable prices
  • Honor all sales and commitments
  • Ship items promptly and as described
  • Respond to buyer inquiries in a timely manner
  • Comply with all applicable laws and regulations

4.2 Prohibited Items

You may not list the following items on the Platform:

  • Counterfeit or replica items
  • Stolen goods
  • Items that violate intellectual property rights
  • Items that violate any laws or regulations
  • Hazardous or dangerous materials
  • Items promoting hate speech or violence
  • Adult content or services

4.3 Pricing and Fees

Currently, listing items on fot.is is free. We reserve the right to introduce fees for listings, transactions, or premium features in the future with reasonable notice to users.

5. Buying

5.1 Buyer Obligations

When purchasing items on the Platform, you agree to:

  • Review item descriptions and photos carefully before purchasing
  • Contact sellers with any questions before buying
  • Complete transactions as agreed
  • Provide accurate shipping information
  • Communicate respectfully with sellers

5.2 Payment and Transactions

Transactions may be completed through external checkout links provided by sellers or through direct contact with sellers. The Platform is not responsible for payment processing, refunds, or disputes. All payment arrangements are between buyers and sellers.

5.3 Viewing Contact Information

Buyers can view seller contact information by clicking "Contact Seller" on item listings. When viewing contact information:

  • You are limited to viewing 5 different sellers' contact information per 24-hour period
  • Only view contact information when you have genuine interest in purchasing
  • Use provided contact information only for completing the transaction
  • Do not share seller contact information with third parties without permission
  • Do not use contact information for harassment, spam, or unsolicited marketing
  • All contact information views are logged for safety and abuse prevention

Note: Attempting to circumvent the daily viewing limit or abusing the contact system may result in account suspension or termination.

6. Communication and Contact Information

6.1 How Contact Information Works

The Platform allows sellers to provide contact information that buyers can view:

  • Seller Settings: Sellers configure their contact information (email, phone, social media) in account settings
  • Visibility Control: Sellers can toggle whether to show or hide their contact information
  • Contact Button: Buyers click "Contact Seller" on listings to view the seller's provided information
  • Rate Limiting: Buyers can view up to 5 different sellers' contact information per day
  • View Logging: All contact information views are tracked for safety and dispute resolution
  • External Links: Sellers may also include external checkout or website links in their listings

6.2 Buyer Responsibilities

When you view and use seller contact information, you agree to:

  • Use it only for legitimate transaction purposes related to listed items
  • Not share seller contact information with third parties without explicit permission
  • Not use contact information for spam, harassment, unsolicited marketing, or phishing
  • Not add sellers to mailing lists or contact databases without explicit consent
  • Respect sellers' privacy and communication preferences
  • Not attempt to circumvent daily viewing limits
  • Not collect or aggregate seller contact information for any purpose

Violation of these responsibilities may result in immediate account suspension or termination.

6.3 Seller Rights and Responsibilities

As a seller, you have control over your contact information:

  • What to Share: You decide what contact information to provide (email, phone, social media accounts)
  • Visibility Toggle: You can enable or disable contact information sharing at any time
  • Update Anytime: You can update or remove your contact information in account settings
  • Safety Recommendations: Use business or transaction-specific contact details rather than personal information
  • Reporting: You can report buyers who misuse your contact information
  • Blocking: You can block specific users from contacting you

Important: Once you provide contact information in your settings, it becomes viewable by buyers who click "Contact Seller" (subject to daily limits). Only include information you are comfortable sharing with potential buyers. We implement rate limiting and logging to protect you, but cannot control how buyers use your contact information after viewing it.

6.4 Rate Limiting and Abuse Prevention

To protect seller privacy and prevent abuse:

  • Buyers are limited to viewing 5 different sellers' contact information per 24-hour period
  • All contact information views are logged with timestamps and user identification
  • Patterns of abuse or suspicious activity are monitored and investigated
  • Users who abuse the contact system face account restrictions or termination
  • Sellers can report misuse of their contact information to our support team

6.5 Platform Communication Tools

We may provide in-platform messaging or communication tools in the future. When using these tools:

  • Communications must be transaction-related and respectful
  • We may monitor communications to prevent fraud and abuse
  • We may retain communication records for dispute resolution
  • Violations of our policies may result in account suspension

7. Content and Intellectual Property

7.1 Your Content

You retain ownership of any content you upload to the Platform, including photos, descriptions, and other materials ("User Content"). By uploading User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your User Content in connection with operating and promoting the Platform.

7.2 Platform Content

The Platform and its content, features, and functionality are owned by Vestra AI ehf. and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Platform without our express written permission.

8. Prohibited Activities

You agree not to engage in any of the following activities:

  • Violating any laws or regulations
  • Infringing on intellectual property rights
  • Transmitting malware, viruses, or harmful code
  • Harassing, threatening, or abusing other users
  • Engaging in fraudulent or deceptive practices
  • Manipulating prices or engaging in price fixing
  • Creating fake reviews or ratings
  • Scraping or harvesting data from the Platform
  • Interfering with the Platform's operation
  • Circumventing security measures

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

We comply with the General Data Protection Regulation (GDPR) and Icelandic data protection laws.

10. Disclaimers and Limitation of Liability

10.1 Platform "As Is"

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

  • The Platform will be uninterrupted or error-free
  • Defects will be corrected
  • The Platform is free of viruses or harmful components
  • Results from using the Platform will be accurate or reliable

10.2 No Responsibility for Transactions

We are not responsible for:

  • The quality, safety, or legality of items listed
  • The accuracy of listings or user information
  • The ability of sellers to complete sales
  • The ability of buyers to complete purchases
  • Disputes between buyers and sellers
  • Shipping, delivery, or returns

10.3 Limitation of Liability

To the maximum extent permitted by law, Vestra AI ehf. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or goodwill, arising from:

  • Your use or inability to use the Platform
  • Any unauthorized access to your account
  • Any conduct of third parties on the Platform
  • Any content obtained from the Platform

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or 100 ISK if you have not made any payments.

11. Indemnification

You agree to indemnify, defend, and hold harmless Vestra AI ehf., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of third parties
  • Your User Content

12. Dispute Resolution

12.1 Between Users

Disputes between buyers and sellers should be resolved directly between the parties. We may, at our discretion, provide assistance or mediation, but we are not obligated to do so.

12.2 With the Platform

If you have a dispute with us, you agree to first contact us at vestra@vestra.is to attempt to resolve the issue informally.

13. Termination

13.1 By You

You may terminate your account at any time by contacting us at vestra@vestra.is.

13.2 By Us

We may suspend or terminate your account immediately, without prior notice, if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • Your account is inactive for an extended period
  • We are required to do so by law
  • We discontinue the Platform

13.3 Effect of Termination

Upon termination, your right to use the Platform will immediately cease. We may delete your account and content. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Iceland, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Reykjavík, Iceland.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform with a new "Last Updated" date.

Your continued use of the Platform after changes are posted constitutes your acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Platform.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vestra AI ehf. regarding the Platform.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
